====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
Learned counsel for the petitioner is directed to remove the defect (s), as pointed out by the office, within a period of four weeks.
The petitioner seeks bail in connection with Sare P.S. Case No. 65 of 2022 registered for the offence under Sections 341, 323, 324, 326, 307, 504 and 506/34 of the I.P.C. The prosecution case, in brief, is that on 06.04.2022 at about 7.00 P.M. in the evening, Shtrughan Kumar (petitioner)
Patna High Court CR. MISC. No.49498 of 2022(2) dt.22-12-2022 2/3 and co-accused Kanhaiya Bind came on a motorcycle in a lane and dashed the informant near the Mosque for which assault and abuse took place in between the parties. The villagers came and tried to pacify the matter. After sometime, Shtrughan Kumar (petitioner), Chintu Kumar, Kanhaiya Bind, Chandu Bind and other 3-4 persons came with arms and assaulted the informant. Shtrughan Kumar (petitioner) and Chandu Bind having knives in their hands assaulted the informant in his chest, stomach, hand and body with intention to kill him, as a result of which, the informant fell down with full blood.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.04.2022. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Nature of injury is said to be simple. No offence under Section 307 of the I.P.C. is attracted in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
