Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-07-2021 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks modification of the order dated 11.12.2019 passed by this Court in Criminal Appeal (SJ) No. 3434/2019. By the aforesaid order, the petitioner was directed to be enlarged on bail in the event of his arrest or surrender before the Court below within a period of three weeks from the date of passing of the order.

However for the reasons which have been explained in the petition, the petitioner could not surrender within the period mentioned in the order dated 11.12.2019. The order dated 11.12.2019 is modified to the

Patna High Court CR. MISC. No.9580 of 2021(2) dt.14-07-2021 2/2 extent that in case the petitioner surrenders before the court below within a period of six weeks from today, he shall be accorded the privilege under the order dated 11.12.2019. with the same terms and conditions.

The order stands modified to the extent indicated above.

The modification application stands disposed of accordingly.
