The petitioner seeks bail in a case registered for the offences punishable under Sections 376, 511, 306 and 452 of the Indian Penal Code.
The mother of the deceased made allegation that the petitioner committed rape with her daughter and on alarm the petitioner fled away. It is alleged that on the next day her daughter committed suicide.
Mr. Bhola Prasad, learned counsel for the petitioner submits that the victim was 32 years old and no case was registered for committing rape. The doctor did not find any sign of rape.
It appears that during the course of investigation the
Patna High Court Cr.Misc. No.11676 of 2015 (3) dt.29-07-2015 2/2 mother and other witnesses have stated about the fact that the petitioner had entered into the house of the victim and made an attempt to commit rape with her and subsequently the victim committed suicide.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
However, the petitioner may renew his prayer for bail after remaining one year in custody.
