Petitioners apprehend arrest in connection with Fulkaha P. S. Case No. 34 of 2023 registered for the offences under Sections 341, 323, 324, 325, 307, 354(a), 379, 385, 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submit that the petitioners are innocent and has falsely been implicated in the instant case due to admitted partition dispute. Further
Patna High Court CR. MISC. No.50058 of 2023(2) dt.23-08-2023 2/2 submission is that there is a case and counter case between the parties. Both the parties have sustained injuries in the alleged occurrence.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named are directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the the satisfaction of the Sub Divisional Judicial Magistrate, Araria in connection with Fulkaha P.S. Case No. 34 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
