JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Barh P.S. Case No.132 of 2017 registered under Sections 406 and 420 of the Indian Penal Code.

It is submitted by Mr. Bibhuti Prasad Pandey, learned Senior Advocate for the petitioner that the petitioner is in no way connected with Gharounda Construction Private Limited to which the complainant Brij Mohand Prasad is alleged to have advanced rupees three lac forty thousand for purchase of a flat. He submitted that the petitioner is an employee of the Syndicate Bank, Patna and has been implicated in the case only because he is brother of

Patna High Court Cr.Misc. No.45973 of 2017 (2) dt.04-10-2017 2/2 co-accused Shashi Shekhar, who is said to be one of the Directors of Gharaunda Construction Private Limited.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the nature of allegation and the submissions made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Barh P.S. Case No.132 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
