2. Petitioner seeks regular bail in connection with Complaint Case No. 1202 of 2025 in a case registered for the offences punishable under Sections 395 and 34 of the Indian Penal Code .

3 . As per prosecution case , on the alleged date and time of occurrence , this petitioner along with other co-accused persons entered house of informant and on the point of pistol looted cash and ornaments of informant.

4. Learned counsel for the petitioner submits that petitioner and complainant are own agnates and there is land

Patna High Court CR. MISC. No.49239 of 2025(2) dt.29-08-2025 2/2 dispute going on between both of them and taking advantage of the same , this petitioner has been made accused in this case . Specific accusation is against other co-accused person . No specific allegation of any overt act is alleged against this petitioner. Rest of the allegation is ornamental in nature . Similarly situated co-accused persons have already granted bail by this Court vide order dated 29.11.2023 in Cr. Misc. No. 74939 of 2023 . Petitioner claims clean antecedent. Petitioner is in custody since 28.04.2025 . Chargesheet has already been submitted.

5 . Learned A.P.P. for the State vehemently opposes the bail application .

6. Considering the nature of accusation , clean antecedent of this petitioner and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM East Champaran Motihari in connection with Complaint Case No. 930 of 2018 .
