The petitioner is languishing in custody since 27.1.2015 in a case registered for the offences punishable under Sections 498A,495,314 and 323/34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
The accusation is of marrying with the informant by concealing the factum of earlier marriage and subsequently, got pregnancy of the informant terminated.
It is submitted by the learned counsel for the petitioner that there is no proof with regard to the marriage or terminating the pregnancy of the informant. The petitioner filed Title Suit No. 555 of 2014 and at earlier point of time the father of the
Patna High Court Cr.Misc. No.15005 of 2015 (2) dt.12-05-2015 2/2 petitioner filed informatory petition before the learned C.J.M. stipulating that the informant and her brother used to threaten for getting him implicating in false cases.
It is submitted by learned counsel for the informant that the petitioner by concealing the fact that he was a married person, exploited the informant.
Considering the nature of accusation and the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Mahila P.S. Case No. 14 of 2014.
