Grievance of the petitioner in the instant writ petition is non-approval of service of the petitioner in the Project (Mahakali) Girls' High School, Dhamdaha, Purnea on the ground that his name does not figure in the Three Men Committee report. Learned counsel appearing for the petitioner has placed reliance on the project report as contained in Annexure-5 where the name of the petitioner finds place at sl. no. 20 and as such the order contained in Annexure-1 rejecting the claim of the petitioner for approval of his service is an error of record.
Considering the fact that the writ application was filed
Patna High Court CWJC No.6510 of 2015(2) dt.27-11-2018 2/2 in 2015 but even after three years no counter affidavit has been filed disputing the factual claim made by the petitioner, the instant writ application is disposed of with a direction to the Director, Secondary Education, Govt. of Bihar to verify Annexure-5 and if it is found that the name of the petitioner figures therein, corrective measures may be taken and thereafter appropriate decision may be taken on the claim of the petitioner by reasoned and speaking order within a period of four months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
