JUSTICE SATYAVRAT VERMA ORAL ORDER 02-03-2022 Heard learned counsel for the petitioner and Shri Prem Kumar Jha, learned A.P.P. for the State. The petitioner seeks bail in connection with Piprahi P.S. Case No. 51 of 2021 instituted for the offences under Sections 395, 412 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 14.05.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the informant in the F.I.R. alleges that he was looted of his motorcycle, mobile phone, Rs. 700/- in cash, Pan Card and other papers by three unknown criminals on two motorcycles. Learned counsel for the petitioner submits that the F.I.R. is against unknown, name of this petitioner transpired in

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.05.2021, charge-sheet has been submitted in the case and his name came in the confessional statement of co-accused which has no evidentiary value, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sitamarhi in connection with Piprahi P.S. Case No. 51 of 2021 with a condition that one of the bailors shall be the father of the petitioner (Shohindra Bhagat).
