JUSTICE RAJESH KUMAR VERMA ORAL ORDER 13-09-2024 Heard Mr. Bindhyachal Singh, learned senior counsel for the petitioner, Mr. Vishwanath Prasad Sinha, learned senior counsel for the Economic Offences Unit assisted by Ms. Soni Srivastava and Mr. Vinod Shanker Modi, learned APP for the State.

2. The petitioner seeks bail, who is in custody since 14.09.2022, in connection with Kutumba P.S. Case No. 218 of 2022, FIR dated 13.09.2022 for the offences punishable under Sections 8/20(b)(ii)(c)/25/29 of the N.D.P.S. Act.

3. Earlier the prayer for bail of the petitioner was rejected vide order dated 01.12.2023 passed in Cr. Misc. No. 8689 of 2023.

4. Learned senior counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that it appears from the FIR that altogether 58 kg of Ganja has been recovered from the vehicle in question and petitioner was arrested along with the aforesaid contraband.

5. Vide order dated 02.08.2024, a report with regard to the present status of the trial was called for. Report of the learned Trial Court dated 13.08.2024 reveals that out of nine witnesses, five witnesses have been examined and four prosecution witnesses are to be examined.

6. Learned senior counsel for the E.O.U. as well as learned APP for the State vehemently opposed the prayer for bail of the petitioner.

7. Considering the facts and circumstances of the case and the fact that the recovery has been made form the vehicle of the petitioner as well as the report of the trial Court, I am not inclined to enlarge the petitioner on bail in connection with Kutumba P.S. Case No. 218 of 2022 pending in the Court of 1st Additional Ditrict & Sessions Judge Cum Special Judge (N.D.P.S.), Aurangabad.

8. Prayer is refused.
