JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2016 Heard learned counsels for the petitioner and learned APP for the State.

The petitioner is languishing in custody since 10.08.2015 in a case registered for the offences punishable under section 8(c), 20(b) of The Narcotic Drugs and Psychotropic Substances Act, 1985 in connection with Udwant Nagar P.S. Case No.165/2003, pending before the learned 1st Additional Sessions Judge, Ara, Bhojpur.

From the house of the petitioner 5 kgs. 'ganza' was recovered.

It is submitted by learned counsel for the petitioner that recovery was from the joint family house and co-accused have already been acquitted.

Patna High Court Cr.Misc. No.5570 of 2016 (2) dt.03-02-2016 2/2 It is submitted by learned counsel representing the Narcotic Bureau that the FIR was registered in 2003 but the petitioner has been arrested on 10.08.2015.

Considering the fact that the petitioner came into custody after 12 years of registration of the FIR, this court is not inclined to grant bail to the petitioner at present. Accordingly, the application for bail on behalf of the petitioner is rejected for the present.

It is expected from the trial Court to conclude the trial within a period of six months.
