2. The petitioner is seeking regular bail in connection with Special (NDPS) Case No. 19 of 2022, arising out of Forbesganj P.S. Case No. 646 of 2022, registered for the offences punishable under Sections 8/20(b) (ii) (C) of the NDPS Act read with Section 25(1-b) A/26/35 of the Arms Act.
3. Earlier prayer for bail of the petitioner was rejected vide order dated 15.03.2023 passed in Cr. Misc. No. 69487 of 2022 taking into account that one loaded pistol and Ganja in huge quantity was recovered from possession of the petitioner.
4. The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case and nothing has been recovered from his possession. It has

No.48923 of 2023(4) dt.13-10-2023 2/2 further been submitted that the co-accused persons, namely, Ajay Kumar Yadav, Avishek Nirala @ Khilanand @ Avishekh Nirala, Manish Kumar @ Manish Darvay, Vivek Kumar @ Vikash @ Vivek @ Vikash Kumar and Pintu Kumar have been granted bail in Cr. Misc. Nos. 66403, 55421, 60242, 58061 and 73197 of 2022.
5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria in connection with Forbesganj P.S. Case No. 646 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
