1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sirdala Police Station Case No. 115 of 2025, dated 25.03.2025, disclosing offences punishable under Sections 115(2)/117(2)/126(2)/308(5)/351(2)/352/3(5) of the Bhartiya Nyaya Sanhita, 2023.

The prosecution case, as per the First Information Report, is that the informant was awarded work for construction of shed for the passengers, for which the petitioner was given an advance amount of Rs. 20,000/- on 23.03.2025. Some persons were not happy with the award of work in favour of the informant and were threatening the informant. On 24.03.2025, while the informant was
Patna High Court CR. MISC. No.48816 of 2025(2) dt.11-08-2025 2/3 coming at about 09:30 PM, the petitioner, along with other co-accused persons, dragged the informant towards the field and snatched Rs. 20,000/-, purse, driving license, ATM and his motorcycle.

Learned Counsel for the petitioner submits that the petitioner is having no criminal antecedent and he has been made accused in this case due to the fact that the informant, who is a contractor and is having partnership with Ajay Singh in the construction work and said Ajay Singh got executed a sale deed in his favour from the father-in-law of Sanju Devi, wife of Pankaj Rajbanshi, for which Sanju Devi filed a complaint in the Court of learned Special Judge, SC/ST (POA) Act, Nawada, against Ajay Singh and others. The father of the petitioner is one of the witnesses in the complaint and the complaint has been referred to the police for registration of the First Information Report and the First Information Report has been registered by the police, bearing SC/ST Police Station Case No. 06 of 2025. With regard to the allegation of snatching the motorcycle of the informant, learned Counsel submits that there has been dispute regrading wages between the informant and co-accused Pappu
Patna High Court CR. MISC. No.48816 of 2025(2) dt.11-08-2025 3/3 Rajbanshi and Rakesh Kumar, for which they kept the motorcycle of the informant, but with the intervention of the police, the motorcycle has been returned to the informant.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the nature of allegation and the fact that the petitioner is having no criminal antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Nawada, in connection with Sirdala Police Station Case No. 115 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
