Petitioner apprehends arrest in a case registered under Sections 323, 498A, 379/34 of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.

An agreement of settlement entered into in the Mediation Proceeding is on the record in this case. The agreement is dated 02.09.2019.

Since the parties have settled the dispute in terms of the Agreement dated 02.09.2019 and are bound by the same, prayer for bail is allowed.

No.49568 of 2019(3) dt.16-11-2019 2/2 Let the petitioner above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Samastipur in CR No 1682 of 2018, TR No 3203 of 2019 subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code and also the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailors will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
