The petitioner seeks pre-arrest bail in connection with Banka P.S.Case No. 477 of 2017 registered under Sections 420, 409 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the petitioner being the Incharge Head Master of New Primary School, Manbaran, Banka has committed no irregularity in construction of the school building and no spot verification was ever made by the informant before lodging the FIR. On the other hand, learned counsel for the State submitted that though the petitioner withdrew certain amount for execution of the construction of the school building, complete

Be that as it may, regard being had to the nature of allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S.Case No. 477 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
