The petitioner seeks bail in Kharagpur P.S. Case No. 99 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The informant heard sound of firing and she rushed out of her house and found her husband was lying, but she did not identifying the miscreants who were fleeing away. Learned counsel for the petitioner submits that during the course of investigation the name of the petitioner figured in the case, but it transpired that Bablu Mandal fired at the husband of the informant killing him on the spot. Two other accused persons namely Sabita Devi and Sanyasi Yadav have already been enlarged on bail vide orders passed in Cr. Misc. No. 25642 of
Patna High Court Cr.Misc. No.11613 of 2015 (2) dt.06-04-2015 2/2 2014 and in Cr. Misc. No. 39978 of 2014 and the case of the petitioner stands on similar footing.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 99 of 2014.
