The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the petitioner pointed pistol on the right temporal region of the informant and fired but due to misfiring no injury was caused. Subsequently, one bag was found at the place of occurrence left by the petitioner from which cartridges were recovered.

It is submitted by learned counsel for the petitioner that it is alleged by the informant that he was threatening to compromise earlier case but in the earlier case the petitioner was not accused. Subsequently, the informant has retracted from his

Considering the fact that as per own admission of the informant no injury was caused and recovery of cartridge was actually not made from possession of the petitioner, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Ara Town P.S. Case No. 79 of 2014, corresponding to G.R. No. 781 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
