2. The petitioner apprehends arrest in connection with Sidhwalia P.S.Case No.41 of 2017 registered for an offence punishable under Sections 384 and 387 of the IPC.
3. The petitioner is neither named in the FIR nor there is any specific allegation against him. It has been alleged that one Kundal Singh had demanded extortion money from the informant using a cellular phone baring no.9652749715. From the impugned order, it appears that in course of investigation, it has been found that one Md. Afroz Hussain had used the said mobile phone which was snatched by him from one Ashok Manjhi. The said Afroj confessed his complicity and disclosed the name of this petitioner and other co-accused. It appears that one of the co-accused Rajesh
Patna High Court Cr.Misc. No.53349 of 2017 (2) dt.10-11-2017 2/2 Mahto @ Rajesh Kumar Mahto @ Shyam Mahto has been allowed anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.43276 of 2017 on 21.09.2017. This petitioner has clean antecedent and his case stands on similar footing.
4. The learned APP opposed the submissions.
5. Considering the nature of allegation facts and circumstances, prayer for anticipatory bail is allowed. Let the above named petitioner the event of his arrest or surrender before the court below within six weeks from today be released on anticipatory bail on furnishing bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-VI, Gopalganj in connection with Sidhwalia P.S.Case No.41 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
