In view of the report received from the 3rd Additional District and Sessions Judge, Buxar, Ara under Letter No. 82 dated 09.12.2016, the last prosecution witness i.e., the doctor was due to be examined on 14.12.2016 and the trial Court had indicated that the case was likely to be disposed off in December, 2016 itself. In view of the aforesaid, the Court is not inclined to consider the prayer for bail of the petitioner. As he has earlier been granted provisional bail but has not yet been surrendered, let him do so latest by 13th January, 2017.
Having regard to the aforesaid, if the petitioner does not surrender, the trial Court shall communicate the fact to this Court and the Registry shall thereafter put the matter before this Bench.
Patna High Court Cr.Misc. No.8851 of 2015 dt.11-01-2017 2/2 Accordingly, the application stands disposed off. However, the Court below is directed to conclude the trial positively by 15th February, 2017, if already not done. Registry shall communicate the order to the Court below through Fax also latest by tomorrow.
