The petitioner seeks bail in connection with Bettiah Town P.S. Case No. 867 of 2012 registered for the offences punishable under Sections 328, 304 and 302/34 of the Indian Penal Code.

The First Information Report is against unknown with the allegation that the dead body of Shambhu Sah was found lying in a drain near clinic of Dr. Sunil Kumar Chaudhary. During investigation, the name of the petitioner transpired in the confessional statement of co-accused Md. Meraj and Birjhan Chaudhary and further the petitioner has also confessed his guilt. No.6439 of 2016 (3) dt.07-04-2016 is no legal and tangible material against the petitioner save and except extra judicial confession, the petitioner has been made victim of police atrocity, resulting he is suffering in custody since 06.08.2015 whereas Md. Meraj and Rajendra Patel have already been allowed bail.

Learned A.P.P. submits that the petitioner has got criminal antecedent.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No.867 of 2012, subject to conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
