Petitioner is apprehending his arrest in connection with Banmankhi P.S.Case No.12 of 2018 , registered for offences punishable under Sections 341, 323, 384, 504/34 of the Indian Penal Code.

FIR discloses that the cousin brother of the informant has taken semi- naked photograph of the informant while she was taking bath and making it viral. It is also alleged that when the informant protested the petitioner and other accused persons assaulted her .

Submission of the learned counsel for the petitioner is that the allegation of taking photograph is against one Niraj Kumar and the petitioner is brother of Niraj Kumar. There is

No.46600 of 2019(2) dt.29-07-2019 2/2 allegation that they have assaulted the informant and others and considering the same, the other accused persons having similar allegations have been granted privilge of anticipatory bail, vide order dated 14.5.2019 passed in Cr. Misc. No.19504/2019.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-Ist, Purnia in connection with Banmankhi P.S.Case No.12 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
