Petitioner is named in the first information report on the accusation that he participated in assaulting the deceased and in that course, he as well as one co-accused put their legs on the chest of the deceased and they pressed the chest of the deceased but post mortem report of deceased reveals that no injury was found on the chest of the deceased.

Moreover, investigation against the petitioner has already been completed and it appears that the alleged occurrence took place on account of land dispute.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
