JUSTICE RAJIV ROY ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and the State through video conferencing in view of the Covid-19. The petitioner is apprehending arrest in connection with Bagaha (Patkhauli) P.S. Case No. 227 of 2022 instituted under Sections of the Indian Penal Code.

As per the prosecution story, the informant alleged that his daughter was married to Aliraj Ansari but later she was tortured for dowry and lastly he came to know that she has been killed. Accordingly, the FIR lodged.

Learned counsel for the petitioner submits that the lady is mother-in-law, an aged person, having no criminal antecedent, living away from the couple and lastly that the husband is in custody (para-16 of the present petition). Learned APP opposes the prayer for bail.

Patna High Court CR. MISC. No.47984 of 2022(2) dt.06-01-2023 2/2 In view of the fact that the petitioner is an aged lady, she is the mother-in-law, the husband is in jail, this Court is inclined to grant her relief.

Let the petitioner be released on bail, in the event of her arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each in connection with Bagaha (Patkhauli) P.S. Case No. 227 of 2022 to the satisfaction of learned ACJM,1st, Bagaha, West Champaran subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Rajiv Roy, J) Ravi/Ajay Singh/- U T
