The petitioner seeks pre-arrest bail in connection with Chausa P.S. Case No. 213 of 2016 registered under Sections 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that the dispute arose out of trivial matter and there is no allegation that the petitioner repeated the assault upon the informant. He submitted that the injury caused to the informant Kishnath Paswan was found simple and, hence, there would be
Patna High Court Cr.Misc. No.58953 of 2017 (2) dt.13-12-2017 no application of Section 307 of the Indian Penal Code. Considering the submissions made above, which find corroboration from the order impugned that the injured Kishnath Paswan had sustained simple injuries, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj, Madhepura in connection with Chausa P.S. Case No. 213 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
