JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 23.02.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

The allegation against petitioners is that they along with other assaulted informant, his brother and one Rishi by means of sword etc.

Admittedly, petitioner no.1 lodged Ishakchak P.S. Case no. 123/2014 against the informant and others for the occurrence of the same day and in the aforesaid case, petitioner no.1 and his brother, too, sustained injuries.

The impugned order of learned Addl. Sessions Judge reveals that informant's brother sustained simple injury though caused by sharp cutting weapon and the informant sustained altogether four injuries and out of them one injury was found grievous in nature.

Patna High Court Cr.Misc. No.7001 of 2015 (2) dt.23-02-2015 No doubt, grievous injury was found on the head of the informant but it is not clear as to who is author of the aforesaid injury. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Nishit Dayal, Judicial Magistrate, Ist Class, Bhagalpur/concerned court in Ishakchak P.S. Case no. 124/2014.
