JUSTICE SANDEEP KUMAR ORAL ORDER 04-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 16.06.2022 in connection with Laxmipur P.S. Case No. 322 of 2021 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, of the Indian Penal Code and 27 of the Arms Act. The injured is a criminal and having 24 antecedents. The petitioner is also having some criminal antecedent and is in custody since 16.06.2022. This is a case under Section 307 and false implication cannot be rulled out.

Accordingly, this application for regular bail is allowed.

In view of the aforementioned facts and

No.48533 of 2022(3) dt.04-02-2023 2/2 circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class Jamui in connection with Laxmipur P.S. Case No. 322 of 2021.

The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the concerned Police Station through his lawyer or by himself on the 1st Sunday of each month, failing which, his bail bonds shall be cancelled.
