The petitioner seeks bail in connection with Khodawandpur (Chhaurahi) P.S. Case No. 218 of 2019 dated 20.10.2019 instituted for the offence under Sections 25(1-A), (25-1AA), 26/35 of the Arms Act.

The iron welding shop of the petitioner is said to have been raided, from where, one country made pistol, four semimanufactured pistol and many iron implements were recovered. The recovery suggested manufacture of firearm weapons. The police had also received secret information that the petitioner manages to get mechanics from outside who help him manufacture the firearm weapons.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.58202 of 2021(2) dt.23-05-2022 2/2 the shop does not belong to him and it is only the guess-work of the police party that the petitioner is involved in the manufacture of firearm weapons.

He does not have criminal antecedents.

There is nothing in the investigation papers, it has been argued which would lend credence to the presumption of the petitioner being a manufacturer of firearms. Regard being had to the period of custody of the petitioner and taking into account that he does not have criminal antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate (Manjhaul), Begusarai in connection with Khodawandpur (Chhaurahi) P.S. Case No. 218 of 2019.
