JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 27.11.2013 in a case registered for the offences punishable under Sections 395 and 328 of the Indian Penal Code. The accusation is of robbing the truck loaded with fish. Name of the petitioner sprang up when the petitioner confessed his involvement during custody in Pipra P.S. Case No. 203 of 2013.
It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner nor the petitioner has been put on test identification parade. Though the petitioner is accused in two other cases but statement has been made in paragraph 3 of the petition that the petitioner is on bail in those cases.
Considering the fact that the petitioner has not been put
Patna High Court Cr.Misc. No.772 of 2015 (2) dt.09-01-2015 2/2 on test identification parade till date, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Sadar, East Champaran at Motihari in connection with Trial No. 5385 of 2014 arising out of Kesariya P.S. Case No. 189 of 2013.
