JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 Petitioner being husband of the victim is languishing in custody since 04.10.2015 in a case registered for the offences punishable under Sections 498A, 302/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after about nine years of marriage for non-fulfilment of dowry demand by causing burnt injury.
It is submitted by learned counsel for the petitioner that petitioner was not aware to the occurrence and only on suspicion the accusation has been levelled. The chargesheet has also been submitted under Section 302/34 I.P.C. Moreover the informant has retracted from the initial version and has filed a petition to that effect before learned Court below.
Considering the thrust of accusation against
Patna High Court Cr.Misc. No.6039 of 2016 (3) dt.02-03-2016 2/2 the petitioner, this Court is not inclined to grant bail to the petitioner at present.
Accordingly the application stands dismissed in connection with Muffasil P.S. Case No. 123 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Katihar. (Dinesh Kumar Singh, J) Shageer/- U T
