The petitioners seek bail in anticipation of their arrest in connection with Kateya P.S. Case No. 296 of 2020 dated 15.09.2020 instituted for the offences under Sections 365, 366 and 34 of the Indian Penal Code. The marriage of the victim was fixed with one Jakaul Ahmad @ Sallu but it could not be performed because of demand of dowry. Later, the victim was
Patna High Court CR. MISC. No.3734 of 2021(2) dt.14-12-2021 2/2 kidnapped/abducted by Jakaul Ahmad @ Sallu, his uncle viz. Noor Mohammad and petitioners and others. It appears from the impugned order that the victim has not yet been recovered.
Considering this fact, I am not inclined to grant anticipatory bail to the petitioners.
The prayer for anticipatory bail is rejected. However, if they surrender before the court below and seek bail, their applications shall be considered on its own merits without being prejudiced by the fact that the present petition on their behalf has not been entertained.
