JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 307/302/34 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner fired on the informant as a result of which he sustained fire arms injury on his stomach and died during course of treatment. Learned counsel for the petitioner submits that there is delay of eight days in lodging of the FIR and there is no explanation of the same. Petitioner is in custody since 21.1.2021.

Learned counsel for the State opposes the prayer for bail and submits that the petitioner is the main assailant of the

Patna High Court CR. MISC. No.57473 of 2021(2) dt.01-02-2022 2/2 deceased.

Considering the nature of accusation against the petitioner, his prayer for bail is refused.
