The petitioner is apprehending his arrest in connection with Dumraon P.S. Case No. 247 of 2015 for the offences instituted under Sections 406 and 420 of the IPC. The prosecution story, in brief, is that on 21.06.2015 at about 1.15 P.M. when the driver of the informant was taking lunch, the petitioner came and influenced the driver to purchase the said truck in question and asked him to test drive the truck. The informant handed over the key of the truck to the petitioner. Thereafter, the petitioner fled away with the truck and he is traceless with the truck till date.
Patna High Court Cr.Misc. No.5635 of 2016 (2) dt.18-03-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case due to dirty village politics. The truck in question has been purchased by the petitioner which is evident from Annexure-2 from the informant as back as in the year 2013 and the said truck is in possession of the petitioner alongwith the liabilities of the Financer. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Dumraon P.S. Case No. 247/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
