Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Aurangabad Town P.S. Case No. 346 of 2020, registered for the offences punishable under Sections 306 of the Indian Penal Code, 1860.

As per allegation, the informant Deepak Kumar lodged FIR stating therein that his father late Sudhir Kumar Sinha who was working in the office of Superintendent of Police, Aurangabad had committed suicide. The informant went

His brother Prashant Kumar @ Bholu apprised that when he opened door in the morning he saw the dead body of the deceased hanging in his room. The reason behind the occurrence is stated that there was some dispute between deceased and his wife Ranjana Sinha who had lodged a case against the deceased and his three sons. A partition suit was also going on between the deceased and step mother of the informant Ranjana Sinha. In the last portion of the FIR it has been mentioned that due to torture of Ranjana Sinha the deceased has committed suicide.

Learned counsel for the petitioner has submitted that the petitioner is not the family member of the informant or said Ranjana Sinha rather he is the 'ward parshad' and is family friend of the informant and his stepmother and he was persuading both the parties to solve their dispute and it was the reason that he has falsely been implicated. Ranjana Sinha, has lodged FIR Aurangabad Nagar P.S. Case No. 38 of 2020, against the deceased and his sons and in her FIR it was mentioned that Deepak Kumar assaulted on the head of the petitioner. Petitioner is not named in the FIR. There is no allegation against him to abet suicide of the deceased. Considering the above-mentioned facts and circumstances, let

No.58038 of 2021(2) dt.05-07-2022 3/3 the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 346 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
