The petitioner seeks bail in Bandeya P. S. Case No. 5 of 2019 instituted for the offence under Section(s) 448, 341, 323, 324, 325, 307,379, 504 and 506/34 of the Indian Penal Code.

Learned counsel for petitioner submits that there is case and counter case between the parties. Both parties are Gotiya. There is land dispute between the parties. It is alleged that co-accused Ramanand Yadav has earlier lodged a case against the informant, Sanjay Yadav and his family members vide Bandeya P.S. case no. 4 of 2019. In the instant case allegation against this petitioner is that he assaulted to Santosh on the head by Gadasa .Injury

Patna High Court CR. MISC. No.44959 of 2019(2) dt.24-07-2019 2/2 report of injured Santosh Kumar has been annexed as Annexure-3 series, which shows that injured has sustained injury on the head by sharp weapon but opinion has been kept reserved.

Petitioner is in custody since 1.5.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Daudnagar Aurangabad Bihar in connection with Bandeya P. S. Case No. 5 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
