JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-12-2022 Heard Mr. Radha Mohan Singh, learned counsel for the petitioner and Mr. Shyameshwar Dayal, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Lalganj PS Case No. 458/2021 registered for the offence punishable under Sections 392 of the IPC.
As per First Information Report, two unknown miscreants snatched Rs 10,000/- from the informant and a sum of Rs. 7,000/- from the counter of CSP of IDFC Bank being run by the informant.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and he is in custody since 01.01.2022 having no criminal antecedent. He next submits that

Learned counsel further submits that no TIP has been conducted by the prosecution and the charge-sheet has already been submitted.
Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 01.01.2022 having no criminal antecedent, no incriminating material and or looted article has been recovered from the possession of the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj PS Case No. 458/2021.
