The petitioner, Khijhan Bhagat, seeks regular bail in Raghopur P.S. Case No.83 of 2014, registered under Sections 307 and other sections of the Indian Penal Code. The informant alleged that Laxman Bhagat demanded Rs.150/- for taking wine. When the informant refused, Khijhan Bhagat, son of Laxman Bhaga, gave repeated blows with barchi on the chest of the informant.

Learned counsel for the petitioner submits that the informant got superficial injuries. Petitioner is in jail since 30.08.2014. The Investigating Officer submitted charge-sheet without obtaining opinion of the injury.

Having considered the facts that the petitioner is in jail for last four months and the opinion of injury has not been obtained by the Investigating Officer, the petitioner, above

Patna High Court Cr.Misc. No.898 of 2015 (2) dt.09-01-2015 2/2 named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Hajipur in connection with Raghopur P.S. Case No.83 of 2014.
