====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-07-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khudwan P.S. Case No. 21 of 2019 registered under Sections 420 and 379 of the Indian Penal Code and Sections 26(a) and 33 of the BMMCR Act.

The accusation is that without obtaining the licence from the Mines and Mineral Department and Clearance Certificate from Environment Department, this petitioner was running the brick kiln in the year 2018-19 and caused loss of Rs.74,500/-

Patna High Court CR. MISC. No.44471 of 2019(2) dt.19-07-2019 2/2 Learned counsel for the petitioner submits that the loss of Rs.74,500/- caused by the petitioner has already been deposited by the petitioner on 29.05.2019 and the Environmental Certificate has already been issued in faovaur of petitioner on 16.03.2016 by the District Officer, Environment Department-cum-DEIAA, Aurangabad, which would appear from annexure A series.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, in connection with Khudwan P.S. Case No. 21 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
