This application, for grant of anticipatory bail, arises out of Matiariya Police Station Case No. 14 of 2017, disclosing offences under Sections 406/420/467/468/34 of the Indian Penal Code.
A complaint petition is the basis for registration of the First Information Report, under Section 156 (3) of the Code of Criminal Procedure, 1973.
The allegation is that the husband of the petitioner had assured the informant of some employment abroad. He had taken some money from the informant and the witnesses to the complaint petition in lieu thereof and subsequently he could neither kept the promise nor return the money. So far as the petitioner is concerned, it is alleged that at one point of time, a cheque was handed over to her.
Patna High Court Cr.Misc. No.48761 of 2017(2) dt.14-11-2017 2/2 Learned Counsel appearing on behalf of the petitioner has submitted that the petitioner has been implicated because she is the wife of the main accused and the main accused has already been arrested and is in jail.
Considering the above submission, this application is allowed.
Let the petitioner, Rama Devi @ Rema Devi, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Matiariya Police Station Case No. 14 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
