Petitioner, in the present case, is seeking regular bail in connection with S. Tr. No. 500/2019 in connection with Noorsarai P.S. Case No. 151 of 2019 (G.R. No. 2884/2019) registered for the offences under Sections 147, 148, 149, 341, 302, 427, 504 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned C.J.M. Nalanda, Biharsharif.
Learned counsel for the petitioner submits that petitioner had moved for regular bail before this Hon'ble Court in Cr. Misc. No. 17740/2020 which was rejected on 03.06.2020. Learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner.
Having regard to the facts and circumstances that
Patna High Court CR. MISC. No.4747 of 2021(2) dt.03-02-2021 2/2 earlier the prayer for bail of the petitioner was rejected only on 03.06.2020 after noticing that he is the main assailant and the shot was fired by him on the vital part on the body of the deceased which proved fatal, this Court is not inclined to grant privilege of regular bail to the petitioner.
This Court has already observed that the trial court expedite the trial. Let the trial court proceed with the trial without granting unnecessary adjournment.
