The petitioner is languishing in custody since 10.09.2014 in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and 47(a) of Excise Act.
Five hundred sachets each 400 ml. of country made liquor was recovered from Auto Rickshaw of Sachin Yadav when it was found that Om Prakash Yadav and this petitioner were carrying the liquor from the shop of one Ajay Yadav. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled when the petitioner was not found in the alleged Auto Rickshaw.
Patna High Court Cr.Misc. No.1857 of 2015 (02) dt.16-01-2015 2/2 Petitioner is accused in four other cases.
Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 399 of 2014.
