JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsel for the petitioners and the State. The petitioners are languishing in custody since 30/09/2014 in a case registered for the offences punishable under Sections 147,148,149, 341, 323 and 302 of the Indian Penal Code.

It is alleged that five FIR named accused including the petitioners and four unknown assaulted the father and uncle of the informant with lathies and butt of pistol. Subsequently the father of the informant succumbed to injuries. The post mortem reflects only one injury whereas the injury report of the uncle of the informant reflects two swelling injuries. There is counter version also and the petitioners' side also received injury.

Considering the fact that the post mortem report and injury report do not corroborate the prosecution version, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000./- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Supaul in connection with Jadia P.S.Case No. 118 of 2014.
