The present writ petition has been filed for quashing the Letter No.222 dated 10.02.2023 (annexed as Annexure-P/1) issued by Civil Surgeon-cum-Member Secretary, District Health Committee, Muzaffarpur by which the petitioner has been transferred from Ward No.1 to Ward No.3 of Center No.74, Bochaha, Muzaffarpur. Further prayer has been made to quash the Letter No.92 dated 17.02.2023 issued by the Incharge Health Officer, Bochaha, Primary Health Center by which the

Patna High Court CWJC No.12742 of 2024(2) dt.29-08-2024 2/2 petitioner has been directed to join and work on Center No.74 of Ward No.3 in the capacity of Asha Karyakarta.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present petition.

4. Learned counsel for the State on the other hand opposes and submits that the petitioner is the Asha Karyakarta and always used to create disturbance in smooth functioning of the work and it is due to administrative reasons, her transfer has taken place.

5. In this background, the present writ petition stands dismissed directing the petitioner that if, she files such frivolous application in future, then cost shall be imposed upon her. Officials are directed to take administrative action in case, it has been found that the petitioner is creating any disturbance or doing lapse in smooth functioning of the work.
