Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Manpur P.S. Case No. 01 of 2021, registered for the offences punishable under Sections 379/34 of the Indian Penal Code. In the night of occurrence the informant noticed that his buffalo was not at his darwaja similarly the buffalo of Madan Paswan was also not there. The villagers began to search and saw four persons were loading buffaloes on a vehicle. Two of them were apprehended who disclosed the name of the present petitioner. Learned counsel for the petitioner has submitted that petitioner is not arrested at the spot. Nothing was recovered from his

Patna High Court CR. MISC. No.58264 of 2021(2) dt.11-07-2022 2/2 possession. His name has been figured only in the confessional statement of co-accused except that there is no material against the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V, Nalanda at Biharsharif in connection with Manpur P.S. Case No. 01 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
