The petitioner, who is in custody in connection with Adhoura P.S. Case No. 42 of 2014 , G.R. No. 1322 of 2014 registered for the offence under Section 302, 201/34 of the Indian Penal Code has prayed for grant of bail.
Learned counsel for the petitioner submits that petitioner is own brother of the deceased and accusation has been made on suspicion by the Chowkidar that petitioner and his father was involved in the murder of brother of the petitioner. He submits that even prior to lodging F.I.R. Sanha entry was made on complaint made by father of the petitioner which has been noticed in paragraph no. 19 of the case diary. He submits that father of the petitioner namely Ram Sewak Yadav who was made accused in the present case on similar accusation has been
Patna High Court Cr.Misc. No.821 of 2015 (3) dt.04-03-2015 2/2 granted bail by this court by order dated 28.1.2015 in Cr. Misc. No. 45334 of 2014.
In view of the facts and circumstances particularly the fact that one of the co- accused has been granted bail, there is no reason to deny the prayer for bail.
Let the petitioner Shiv Prasad @ Shiv Prasad Yadav be enlarged on bail on furnishing bail bond of Rs. 10000/- (Rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Adhoura P.S. Case No. 42 of 2014, G.R. No. 1322 of 2014.
