JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 22.10.2014 and 10.10.2014 in a case registered for the offences punishable under Sections 448,504,323,342,302 and 379/34 of the Indian Penal Code.

It is alleged that the accused persons came at the door of the informant, abused him, took him to their house, brutally assaulted and confined in a room when the father of the informant came to get the informant released, the accused persons assaulted the father of the informant as a result of which he died. Subsequently, the informant was released though they snatched jewellery and rupees forty five thousand four hundred cash also. It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.1670 of 2015 (2) dt.15-01-2015 2/2 that the postmortem report of the father of the informant suggests only one injury on the back of the head though haematoma was found on the opening of the skull in the occipital region though the accusation is of making assault by ten FIR named accused persons by lathi and fists and slaps. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the fact that the accusation is omnibus and general and the same is not being corroborated by the opinion of the doctor recorded during postmortem, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Muzaffarpur in connection with Bochahan P.S. Case No. 177 of 2014.
