1. Heard the parties.
2. The prayer of the petitioner is for a direction to the police authority to re-investigate Rahui P.S. Case No. 630 of 2024 dated 01.12.2024 registered under Section 281 / 324 of the B.N.S. Act.
3. Learned counsel for the petitioner submits that the first information report was lodged on 01.12.2024 stating therein that while the informant was returning to his home by his Nexon Car of Tata Company having registration no. JH15AD9923 and no
Patna High Court CWJC No.12508 of 2025(2) dt.20-11-2025 2/3 sooner than he reached near Sohsarai railway crossing a milk truck bearing registration no. BR04GC8945 dashed the car of the informant. The informant lodged the F.I.R. bearing Rahui P.S. Case No. 630 of 2024. The petitioner is the owner of the milk truck bearing registration no. BR01GC8945. The police investigated the case and filed charge sheet against the driver -Kameshwar Singh. It has further been submitted that damage report has not been ascertained from the MVI by the police during the course of investigation. The driver of the milk truck Kameshwar Singh has taken photograph of the damaged car which clearly shows that damage is caused near the front side including the right side of the car whereas the allegation is that milk truck dashed the car from behind. Accordingly submission is that re-investigation may be directed in the present case.
4. I have heard learned counsel for the parties. The petitioner has filed the present writ application for reinvestigation of the case and has also annexed copy of the case diary. Though copy of the case diary is not supposed to be available to the petitioner at this stage inasmuch the trial has not begun and copy of case diary has not been provided to the petitioner however, in order to file frivolous case copy of case diary has been obtained by illegal means and the present case
Patna High Court CWJC No.12508 of 2025(2) dt.20-11-2025 3/3 has been filed wasting the time of the court. The case has been filed in abuse of the process of the court. Accordingly, I do not find any reason to entertain this writ application. The same is dismissed imposing Rs. 10,000/- cost upon the petitioner. The cost amount shall be deposited by the petitioner in the Patna High Court Legal Service Authority within one month. (Anil Kumar Sinha, J) praful/- U
