JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 09-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Deceased had prevented petitioner, Chandi Manjhi, Mantu Manjhi, Rohit Manjhi and Tunni Manjhi to enter inside his house who were heavily drunken, been assaulted by all of them. He raised hue and cry attracting his nephew and wife of nephew whereupon he was rescued and to that extent the written report was filed.

As there was no apparent injury on account thereof, informant / victim remained at his house. Police came, took statement of him as well as his nephew and wife of nephew including other. Subsequently, informant developed some sort of complication and later on died at his residence. Accordingly, postmortem was conducted over dead body and during course thereof, only one injury has been found fractured of north side of mandible. The cranial cavity contains blood leading to cardiac arrest which happens to be the cause of death.

That being so, petitioner Chandi Manjhi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S.
