JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 17.02.2014 in a case registered for the offences punishable under Sections 302, 307/34 of the Indian Penal Code and 27 of the Arms Act. According to prosecution case itself, it was coaccused, Chhotu Prince who opened fire on the deceased and so far as petitioner is concerned, he was only present along with the aforesaid Chhotu Prince and other accused. Petitioner carries criminal antecedent of three cases but submission on behalf of the petitioner is that he has already been granted bail in almost all the cases.

Considering the aforesaid facts and circumstances as well as period of dentition of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.830 of 2015 (2) dt.09-01-2015 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, Patna in connection with Khajekala P.S. Case No. 252 of 2013.
