2. The petitioner seeks bail in connection with Raghopur (Rustampur O.P) P.S.Case No. 92A/2020 instituted for the offences under Sections 414/34 of the Indian Penal Code and Sections 30(a)(c)(d) and 41 of the Bihar Prohibition and Excise (Amendment) Act 2018.

3. On secret information that some people, including the petitioner, are continuing with their trade in illicit liquor, a raid was conducted but nobody was apprehended. 220 litres of country made liquor was found at the place where the accused persons had congregated. The petitioner was only seen running away from the place of storage of the liquor.

4. Though the petitioner has been made accused in seven cases, but in three of such cases, he is on bail. Presently, the petitioner is in jail since 15.05.2024.

5. Considering the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. II-cumAdditional Sessions Judge, Vaishali at Hajipur in connection with Raghopur (Rustampur O.P) P.S.Case No. 92A/2020.

6. While saying so, this Court has also taken into account that a similarly situated accused person, viz., Bhulu Rai @ Bhulu has been granted bail by this Court vide order dated 21.06.2024 passed in Cr. Misc. No. 39276 of 2024.
