JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 15.02.2016 Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.
Petitioner took Rs 2, 19, 960/- on the pretext of transferring his land in favour of the informant and also executed Baibeyana but later on, did not execute absolute sale deed nor returned the amount. The contention on behalf of the petitioner is that even if the story as propounded by the informant assumed to be true, then also, fact of the present case constitutes a civil litigation. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Raxaul East Champaran at Motihari in Adapur (Nakardei) P.S. Case no. 90/2015.
